A New Carlisle Resident has been found guilty of trafficking in drugs, having weapons under disability, and bringing drugs into a detention facility.

Clayton Allen, 43, was found guilty on May 11 and immediately incarcerated in the Ohio Department of Rehabilitation & Corrections.

Allen was charged with trafficking in drugs following a traffic stop on July 4, 2017.

The report from the deputy states that Allen and his passenger were northbound on Osborn Rd. from Lower Valley, when the deputy noticed that both were acting suspiciously.

Allen then pulled the vehicle into a driveway on Osborn Rd. in a reckless fashion. The deputy turned on his overhead lights and the driver and passenger quickly opened the doors and tried to exit. Both were advised to stay in the car.

Allen got back into the vehicle and was moving around inside. He was then told to show his hands and exit the vehicle. He came out, but went back and threw something in the car.

Both Allen and his passenger were handcuffed.

The deputy soon learned that Allen was under several suspensions, so he decided to have the vehicle towed.

While conducting an inventory of the contents, he found two plastic baggies containing a “crystal-like substance.”

Allen was advised that he was under arrest for the suspected drugs, and he said that they were not his, but his passenger’s.

He was advised that he was in control of the vehicle and it was his responsibility to make sure illegal items are not in his vehicle.

He was arraigned on Wednesday morning (July 5), pleaded not guilty and in the Clark County Jail on $50,000 bond. Allen was found guilty on May 11 and immediately incarcerated.

Allen also has to face charges from a January 25, 2018 incident where police raided his home and another address in the City of New Carlisle. A court date has not been set for those charges.

The Ohio State Highway Patrol has identified the driver of the white pickup truck involved in a one-car rollover crash on Gerlaugh Rd. at Rt. 235 Tuesday afternoon as Benjamin S. Parsons, 45 of Dayton.

According to a release by the Patrol, at approximately 3:28pm on May 8, a 1997 Dodge Ram pick-up truck driven by Parsons was traveling eastbound on Geralugh Rd. Parsons drove off the right side of the roadway and overturned several times and was ejected from the vehicle.

According to a witness, the white pickup truck had been driving erratically and at a high rate of speed since the I-70 interchange.

Parsons was transported to Miami Valley Hospital by Care Flight with critical injuries where he was pronounced deceased shortly after arriving.

The Ohio State Highway Patrol is investigating the accident.

A Bethel Township (Miami County) man pleaded not guilty Monday, April 9, to felony rape and gross sexual imposition of a minor indictments.

John Maingi, 38, faces two felony counts of rape and two felony counts of gross sexual imposition, according to the indictment filed in Miami County Common Pleas Court.. 
Judge Jeannine Pratt set bail at $400,000 cash or surety.

The indictment alleges the offenses occurred between August 2011 and December 2016. One rape count states the alleged victim was less than 10 years old. The second rape count states the alleged victim was less than age 13. The case involves one minor. 

Pratt said one rape charge carries a potential sentence of 15 years to life, while the second carries a sentence of 10 years to life. The gross sexual imposition charges carry maximium sentences of five years each.
Maingi's pretrial hearing was set for April 16 before Judge Christopher Gee.

Tyler Hughes, of Frayne Dr., reportedly led Clark County Sheriff deputies on a high-speed chase through residential areas of Park Layne on Friday evening (February 5).

A deputy spotted Hughes driving a Dodge Durango on Gerlaugh Rd., and the deputy knew that he had several warrants.

The deputy followed Hughes, on Stratmore, Weinland, Frayne and Campbell, reportedly at speeds of 75 MPH at times.

Documents filed with the Clark County Municipal Court allege that Hughes tried to lose the deputy by making numerous turns “with disregard for anyone in the area.” The report states that Hughes was fishtailing and driving in a reckless manner.

Hughes reportedly turned onto Campbell from Weinland, ran over the stop sign and went into a yard. He got back onto the road and turned onto Frayne. He then locked his brakes, slid over the stop sign and fled on foot.

The deputy tased him, cuffed him and placed him under arrest for Failure to Comply and Resisting Arrest.

He plead Not Guilty at his arraignment and has his pre-trial on February 20.

Hughes’ warrants stemmed from an incident in Miami County on February 2. At 1:49 p.m., a deputy was sent to a trailer park near Brandt for a report from a woman that Hughes was beating up her daughter. Dispatch reported hearing screaming in the background. The woman told dispatch that Hughes was dragging her daughter outside and ripping her clothes off trying to get her into a Dodge Durango. She said that they left and believed that her daughter was in extreme danger.

The woman said that Hughes is her daughter’s boyfriend and that they have children together. She said that her daughter came to her home claiming that Hughes had pistol-whipped her at their home in New Carlisle. She said that Hughes came to her home shortly afterward and said that she was leaving with him. The daughter said that she wasn’t going to leave. She said Hughes then tried to force her out of a chair and dragged her to the front door. She said she tried to stop Hughes, but he pushed her to the ground injuring her arm. She said that during the fight, her mirror was broken and that there was glass all over the floor. She said the fight continued down a hallway and that her daughter tried to lock herself in the bathroom, but Hughes pulled her out of the home.

The deputy saw evidence of a struggle.

The deputy was advised that Clark County had located the vehicle and the daughter was in it.

The deputy went to Medway to speak with the girlfriend and gave her a domestic violence packet.

Deputy Nick Anderson was on the scene and he said that Clark County deputies were searching for Hughes and had a warrant for his arrest for assaulting someone with a pistol last week.

The girlfriend said that she and Hughes had been together for six years and they just got married last June. She said that she has four children and that Hughes is the father of three of them.

Hughes was arrested for abduction and is in the Miami County Jail.

 

One person died in a crash at Route 201 and Singer Rd. Thursday evening.

According to initial reports, a Hyundai was southbound on 201 when it went left of center and hit a pickup truck head-on.

The driver of the pickup was pinned in his vehicle by his ankle and was extricated by Bethel Twp. (Miami) Fire crews.

The driver of the Hyundai, Jennifer Duffy, 48, of Dayton, was pronounced dead at the scene.

It is not known why Duffy crossed the center line.

The Bethel Township Fire Department was dispatched to the 9000 block of Lower Valley Pike around 8:30pm on a report of smoke in the residence.

Upon arriving, the firefighters discovered the house filled with thick smoke. The occupants had already evacuated into the frigid temperature outside. The homeowners were out of state on vacation.

Firefighters continued with their investigation when flames began to appear. Mutual aide was quickly dispatched and firefighters struggled to gain control of the fire in the large farm house.

The flames appeared to begin on the first floor stairwell, but soon spread to the basement and upper-floors. Firefighters had to use ladders to access any portion of the second floor where they discovered fire in the walls and in the floors.

It is unclear at this time what started the fire.

It is confirmed that  a fire investigator is on scene.

“I had my two daughters in that home. I raised my children there. It's just sad” said a neighbor, who kindly let me warm up in her vehicle.

Mutual Aid is being provided by the following fire departments: Mad River, New Carlisle, Bethel Township (Miami County), Springfield Township, Wright-Patterson AFB & Pike Township.

On Tuesday, December 26, Clark County Sheriff Deputies went to 11444 Gerlaugh Rd. to search for Chris Milem. Milem had outstanding warrants for drug possession and for carrying a concealed weapon.

When Deputies Beller and Johnson arrived, the Deputies saw Clifton Ferguson in a car in the driveway. Ferguson also had outstanding warrants. Ferguson then ran into the house and Milem came out. Milem was placed under arrest and put in a cruiser. Deputies then went into the house to get Ferguson. Two individuals in the house said that no one else was there.

The deputy told them that he knew they were lying and began to look through the house. Ferguson was located in a bathroom and was arrested. A woman at the house was asked if anyone else was in the house and she said no. She was standing blocking a doorway. Deputies asked if they could check that room and she gave permission.

In that room, deputies found a safe that had the lock drilled out of it. In the safe were several knives and what looked like a gun. They also found drugs and a scale.

The house was locked down and the K9 was summoned.

Deputy Doolin and K9 Gordon checked the car and indicated the presence of drugs. The car was searched and deputies found meth, a scale, a container with meth residue, two cell phones and syringes.

Milem and Ferguson were taken to the Clark County Jail.

A search warrant was obtained for the residence, and the search yielded suspected meth, scales, meth pipes and two stolen motorcycles.

Milem was charged with 2 counts of receiving stolen property.

Ronald Cobb has been elected to New Carlisle City Council.

The final vote total put Cobb two votes over Chris Shamy.

The preliminary figures released on Election Night showed Shamy ahead of Cobb by 6 votes.

After the provisional ballots were tallied, Cobb was ahead of Shamy by one vote.

This triggered an automatic recount that was conducted on Thursday, November 30.

When the Board of Elections conducts a recount, they physically count each ballot from one precinct. If that matches the total after provisional ballots are counted, then it is assumed that the other precincts are correct.

After three counts of one precinct, the Board could not come up with a total that matched the total that they had. They hand counted each individual ballot that was cast.

"It's extremely important that we are able to count physical ballots by hand" said David Hartley, member of the Clark County Board of Elections. "There are counties in Ohio that are all electronic. You wouldn't have the backup option to inspect each physical ballot."

The last time the Board of Elections conducted a recount was in November, 2015 in a Greenon Local School Board race.

“This is proof that every vote counts,” said Jason Baker, Director of the Clark County Board of Elections.

“I feel bad for Chris,” said Cobb, “but I will work to regain the trust of the citizens.” Cobb said he was ready to go to work and hold the city accountable for what they promised.

“It was a good run,” said Shamy. “I want to congratulate Ron on his victory.”

“I would like to congratulate Mr. Cobb,” said City Manager Randy Bridge. “I’m looking forward to working with all new council members.”

A Bethel Township man is facing charges of child endangering and manufacturing methamphetamines after an illegal burn led detectives to his “meth lab.”

At 5:40 p.m. on Tuesday, November 14, the Clark County Sheriff’s Department was called to the 2000 block of South Dayton-Lakeview Rd. in reference to a possible methamphetamine production complaint after the manager noticed a “strange chemical smell” coming from one of the apartment buildings. While en route to that location, Detective Nawman observed a large illegal burn in the backyard of 11444 Gerlaugh Rd.  Nawman contacted Bethel Township Fire & EMS to investigate and continued on to the S. Dayton-Lakeview Rd. address.  According to the Sheriff’s report, Nawman found nothing indicating narcotics manufacturing at this address.

Detective Nawman and Sergeant Evans-Fisher then responded to Gerlaugh Rd to check on the illegal burn. Nawman observed what appeared to be “components to a methamphetamine lab” in the remnants of the fire pit.

At this time Detectives Sanders and Fader were dispatch to conduct an investigation.

The detectives spoke with Christopher Milem who advised that he was unaware of the contents of the fire, but that Larry Jenkins started the fire. Milem and Jenkins both agreed to allow detectives to search the residence with Milem’s girlfriend, Jennifer Milligan, providing the signature authorizing the search.

According to the report, Detectives searched the Jenkins' bedroom and located a pipe for smoking meth, two digital scales and several plastic baggies. In the closet, detectives located a propane canister and long, clear rubber tubing.

In the basement, Detectives located a silver box containing several glass pipes and more propane canisters.  Detectives also noticed several baby items stored in the basement. Milligan has a newborn in the residence and identified Milem as the father.

The search then moved to a white trailer outback of the residence. Inside the trailer, detectives discovered a pack of white pills labeled “MethylPREDNIsolone”, instant cold packs, various chemicals in aerosol cans, and gloves.  “Those items, used in accompaniment, are indicative of the production of methamphetamine” said Detective Sanders in his report. At this time, detectives requested assistance from Detective Collins with the Springfield Police Department as he is trained in the detection of meth labs.

 Detective Collins indicated that he believed this was in fact a “meth lab.”

Searching the remnants of the fire, detectives found rubber tubing, two ceramic dishes, several twenty ounce bottles and two blue canisters similar to what was located inside. Next to the fire, detectives discovered two aerosol cans with the plastic valves removed from their tops.

With this information, Larry Jenkins was charged with endangering children and the illegal assembly or posession of chemicas for manufacture of drugs.

“This incident is another example of the ongoing efforts by Sheriff Burchett and the Clark County Sheriff’s Office to keep her campaign promise to protect the entire community from the scourge and impact of illegal drugs” said Lt. Shultz in a media release.

On Wednesday morning, Larry Jenkins entered a plea of innocent in Clark County Municipal Court and is being held in the Clark County Jail on a $25,000 bond.

A 22-year-old man was taken to Miami Valley Hospital Thursday evening for a gunshot wound to his back.

The man and his friend went to “buy some green,” and the victim was robbed and shot.

The friend said the shooting happened on the west side of Dayton, possibly on Salem Ave. They both then drove to the victim’s parents’ home on McAdams Dr. Deputies were notified when the two were enroute.

Deputies were later advised that the shooting may have happened in Huber Heights.

The victim was in undetermined condition, but was described as “alert” when taken by Bethel Twp. Medics to the hospital.

“We went to buy some green,” said the friend, “and some guy robbed him and shot him.” The victim was shot in the back just to the right of his spine.

Clark County Deputies were sent to the scene at 9:32 p.m., and the friend said that it took them about 20 minutes to get here.

Bethel Medics were advised to stand by until deputies arrived and made sure the scene was safe for them to enter.

The names of the victim and the friend were not yet released.

The incident remains under investigation by the Clark County Sheriff’s Office. Huber Heights Police were also dispatched to the McAdams Dr. home in case the incident happened in their jurisdiction.

UPDATE: The scene of the shooting now appears to be in Huber Heights. Their officers were sent to the scene to interview the friend and collect evidence.

 UPDATE: Investigators have determined that the shooting occurred during a home robbery on Schoolgate Rd. in Huber Heights. Huber Police are investigating.

A Park Layne man led Clark County Sheriff Deputies on a high-speed chase Sunday morning that ended in Tipp City.

According to a release issued by Sgt. John Rogers of the Clark County Sheriff’s Office, a deputy tried to conduct a traffic stop on Charles Dean Wiley at 12:27 a.m. Wiley then reportedly fled and crashed his truck into a ditch near Route 571 and Interstate 75. He then reportedly fled on foot. He was apprehended by law enforcement and taken to the Clark County Jail.

“Wiley has a long and extensive history of running from law enforcement officers and endangering the lives of other drivers on the roadway,” said Rogers in the release.

Wiley had outstanding warrants for Felony Receiving Stolen Property, fleeing and eluding, Obstructing Official Business, Reckless Operation, Criminal Damaging, Driving Under Suspension and Driving Without a Motorcycle Endorsement.

Wiley was also wanted by Fairborn Police for Failure to Appear on charges of Carrying a Concealed Weapon, No Driver’s License and Driving Under Suspension.

He will also face additional charges stemming from the pursuit, which include fleeing and eluding, Resisting Arrest, Obstructing Official Business and several other traffic-related charges.

Clark County Sheriff’s Deputies captured a suspect believed to be Jonathan Rockey on Friday morning at Richie’s Sunoco on Lower Valley Pike at Gerlaugh Rd.

Rockey led Springfield Police, Clark County Sheriff Deputies and Ohio State Patrol troopers on a chase from Springfield to Spangler Rd. near Union Rd. Thursday evening. He left his vehicle in a field and fled on foot.

“The manager saw him walking down the road,” said Jamie Crowley, an employee at Richie’s. “I knew there was a guy on the loose from what I saw on the New Carlisle News website last night.”

She said the suspect came into the store to buy cigarettes. “He smelled like smoke – like he had been out in the woods all night.”

Crowley said that the suspect then left the store and asked a gas customer for a ride to Rancher’s. “I’m glad he didn’t get in her car,” she said.

“The next thing I knew, the deputies arrived and had him on the ground with their guns drawn,” said Crowley.

Sources tell us that they are 99% sure the suspect is Jonathan Rockey.
